When Can Jenelle Evans and David Eason File for Divorce?
Jenelle Evans’ return to Teen Mom: The Next Chapter hasn’t been particularly eventful, at least not yet. Evans appears to be on her very best behavior and is trying to add value to the beleaguered series by discussing her upcoming divorce.
During a recent appearance, Evans revealed the moment that made her leave David Eason for good. Even her harshest critics can admit that she seems pretty resolute in her decision. Still, she has yet to file for divorce. The troubled reality TV star has a good reason for that, though. Legally, she has to wait a year to file. So, when can Jenelle Evans officially file for divorce from David Eason?
There’s a timeline for when Jenelle Evans and David Eason can file for divorce
Jenelle Evans and David Eason seem to despise each other now. They don’t seem to have any interest in ever getting back together. So, when exactly can Jenelle Evans file for divorce?
According to North Carolina state law, couples seeking a divorce must live separately for one year before filing for divorce. Because the state only allows for no-fault divorces, the legal separation period must be completed before filing any official paperwork.
Jenelle Evans filed for legal separation in March 2024, but she stated that she and Eason were separated and living apart beginning on Feb. 16, 2024. Because of state law, Evans can not file for divorce until Monday, Feb. 17, 2025. That date is still months away, but based on Evans’ recent Teen Mom: The Next Chapter appearance, she won’t be changing her mind about proceeding with the divorce.
Evans said that she had contemplated ending her marriage for at least a year before she made the final call. Viewers are skeptical because she has walked away from Eason in the past, only to return months later. For now, the separation is sticking.
David Eason can not comment on anything Evans has said
While David Eason surely has an opinion about everything Evans shared during her appearance on Teen Mom: The Next Chapter, he has to stay quiet, at least for now. Jenelle Evans was granted an order of protection against David Eason in May, alleging increasingly menacing behavior. The order precludes Eason from talking about Evans on social media.
E! News caught up with Eason and asked him for a comment. He told the publication that he was not allowed to discuss Jenelle. Eason did tell the publication that her statements about him were false and that the “truth” would emerge, though. The restraining order that prevents Eason from talking about Evans on social media expires in November. In theory, she could return to court to extend the order, but the judge working her case didn’t seem exactly pleased about issuing the first order of protection.
It’s possible Eason will resume his TikTok live sessions when the order of protection expires if he and Evans haven’t patched things up by then. Only time will tell.
